Legal requirements for marriage in Kenya

The Marriage Act, 2014 consolidates all laws on marriage and divorce in Kenya for legal validity.

The law here only recognizes five types of unions; civil, customary and religious (Christian, Islam and Hindu) marriages.

However, Section 22 of the Act recognizes any union celebrated outside the country as long it’s done according to the legal process of that country.

Basic requirements:

• An e-citizen account (all government documents and payments are processed here), go to Registrar of Marriages.
• ID cards
• Birth certificates
• Passports
• Passport size photos
• Requisite registration fees
• Proof of no impediment

Additional documents:

• Proof of no impediment
• Death certificates (bereaved by spouses)
• Divorce decrees

The process:

• File a 21-day notice to allow for verifications and (or) any objections.
• If the notice elapses without incidence, you’ll submit an affidavit and marriage certificate form, all commissioned by the Registrar of Marriages.
• If you can’t wait out the notice duration, send the registrar a justification letter explaining your situation for consideration.
• The marriage must also be solemnized within 90 days from the date of notice.

Fees

The marriages certificate costs Kshs. 50,000 and that’s beside other accompanying costs that include the notice, special license and other legal fees. Budget for about Kshs. 80,000 – 100,000.
